摘 要
在经济高速发展的今天，中国社会正发生着广泛而深刻的变革,我国的经济、政治、文化和社会等各方面都发生了巨大变化,这深刻地改变了人们的思想意识、价值标准、思维方式和生活习惯。社会结构的转型,在促进我国社会巨大进步的同时，也导致一系列社会深层次问题日益凸显，如社会贫富差距扩大、两极分化严重、社会腐败愈演愈烈等等，从而导致社会矛盾和冲突更加复杂和尖锐。按照经典的社会学理论，我们可以说，我们现在在很大程度上处于一个失范的时代。
在这个时代里，法律在社会团结中的作用，实在是一个特别值得关注的课题。迪尔凯姆对于人类历史上的社会团结有很好的论述，沿着迪尔凯姆的思路，我们或许能对中国当下社会团结中法律的作用以及局限有更清楚的认识。
本文主要采用历史分析和文本分析的研究方法，通过历史分析方法，展示迪尔凯姆社会学思想的理论渊源和基本观点；通过对文本内容的梳理以展示迪尔凯姆法律思想的主要表现。沿着迪尔凯姆的进路，以其《社会分工论》中的法律思想为主线，结合庞德、哈特、凯恩等人的法社会学思想，严格区分法律现象与道德、宗教现象，对法律在社会团结中的作用与局限进行相应的总结与阐述。通过对这一课题的研究，进一步思考社会转型时期中国的法律与社会的关系，尤其是法律如何更有效地维系中国社会的秩序与和睦，如何更有效地促进中国社会的整合与团结，以推进中国和谐社会的建设。

ABSTRACT
Nowadays, with the rapid development of economy, China is undergoing extensive and profound changes in terms of economy, politics, culture, society and so on. This has brought significant changes on people's ideology, value standard, way of thinking and living habits. The change of social structure has propelled the great progress of our society. However, it also brought about a series of social problems, including the expansion of the gap between the rich and poor, the seriousness of the social polarization, the intensification of social corruption, as a result, the social contradictions and conflicts are more complex and severe. According to the classical theory of sociology, we can say, we are to a great extent in an age of anomie.
In such an age, the rule of the law in promoting the social solidarity is indeed an issue worth much attention, Emile Durkheim has made valuable statements on the social solidarity of human history. On the basis of his ideas, we may be able to know more about the effects and limitations of the law in making our society solidity.
When composing this paper, the author uses methods of historical analysis and text analysis. Historical analysis helps demonstrate the origin and basic views of Durkheim's sociology, and textual analysis helps to show the main representations of his law ideas. In accordance with his ideas and with his thoughts in The Division of Labour in Society as the main line, we combine Emile Durkheim's sociological ideas with those of Pound's, Hart's and s so that we can distinguish strictly the phenomenon of the law, morality and religion and summarize and elaborate the effects and limitations of the law in making our society solidary. Through studies on this issue, we should make a further consideration of the relations between the law and society of China, especially the way of the law's in maintaining Chinese society's order and harmony and promoting the integrity and solidification of Chinese society in the purpose of propel the establishment of harmonious society of China.
