内容摘要

近年来随着经济的迅速发展,房地产交易市场的繁荣,预售成为我国房地产交易的一种重要形式。但由于市场体系不完善,商品房预售交易中违规、违法现象和买卖纠纷层出不穷。商品房预售制度逐渐开始遭受质疑。本文通过对我国商品房预售制度的由来、社会现状以及我国现行相关制度的优劣之处分析,认为贸然取消商品房预售制度并非保护买受人利益的合理方法,并就我国的商品房预售制度中存在的交易不公平、销售不规范等问题提出相应对策:(一)加强监管;(二)完善商品房预售信息公开制度;(三)从银行方面避免假按揭现象;(四)购房者应做好相应的辅助工作。

Abstract

With the rapid economic development in recent years, the prosperity of the real estate market, pre-sale becomes an important form of real estate transactions. But the market system is imperfect .it appears real estate sale transactions, irregularities, violations and trade dispute one after another. Real estate sale system gradually began to be doubtful. Based on the real estate sale in origin of china , social status and our current strengths and weaknesses are related to system analysis. That a hasty withdrawal of the protection system is not real estate sale means the buyer interests and there is unfair trade to our system of real estate sale . Sale was not standardized, propose the strategy of: (a) strengthen supervision; (b) improve the information disclosure system for real estate sale; (c) avoid the phenomenon of false from the bank ; (d) houses buyers should make the corresponding auxiliary work.
